Owners Association Services Overview
An Owners Association or Community Association is responsible for the effective operation and management of the common areas and facilities within Jointly Owned Property.
Typical examples of jointly owned properties include high rise apartment and office buildings, retail and commercial towers or low rise villa communities. Common areas that are jointly owned may be shared recreational facilities, including gyms and swimming pools and will also consist of common area services such as cleaning, security, lifts, landscaping and pest control, as well as the planned preventative maintenance of the plant and machinery servicing the property.
The Dubai Jointly Owned Property Law (Law 27) came into effect as of April 1st, 2008 however the Regulations which provide the framework and guidelines for the operation of the Law are currently pending release.
It will be compulsory that all Jointly Owned Property, whether in planning, progress or completed stages, must become compliant with the law, regulations and directives issued by Dubai Land Department and RERA.
Once implemented, the Regulations will require that Dubai developers become compliant with the Law and Regulations and register the Owners’ Associations for their projects with RERA on the “Mollak” system.
Once registered the Owners Association will become a legal entity and the control, operation and management of the common areas and facilities can be transferred to the Owners Association.
It is the role of the Owners Association to manage, operate, administer and maintain the common areas and facilities within the jointly owned property. All owners are members of the association and all must contribute to the cost of maintenance and management of the common areas and facilities through the payment of Service Charges.
